as i said, the owner gets to decide. obviously, if the owner permits
copying, he isn't going to sue anyone when they copy it and a judge

But if the owner objects ....

then you may find yourself in a lawsuit. another duh.

it also doesn't mean a judge will ultimately decide. it could be
settled out of court, so you're wrong on that too.

A settlement out of court does not have the authority of a judicial
ruling.

so what?

you're still liable for infringement and will have to pay.

Depends on the terms of the settlement. I know more than one where the
plaintiff has to cough up.

so what?

each case is different.

you're still on the hook for legal fees defending yourself.

Not if the plaintiff agrees to pay them.

Why not? It is a copy in fact.

april fools, right? you can't be serious.

do you not understand the difference between pixels in a frame buffer
versus a copy of a file on a hard drive/ssd?

Not from this point of view. Is there a difference?

absolutely.

What is it?

the issue is not downloading, but keeping a copy without permission.

How long do you need to keep it to infringe the copyright? 10mSec? No.
How about 10 sec? What about 10 minutes? If 10 minutes is OK, what
about 10 hours, or even 10 days? If an artist uploads an image for
viewing how long can it be retained before copyright is infringed?
What is the rule? How do you decide? How do I decide?

time is not a factor.

So you have offended even if the image is on the screen for no more

So I can view an image on my screen, and I'm OK. Then I go to some other
web page- doesn't matter what. But I click the back arrow, and come back
to the previous image. This time, however, the image was not downloaded,
it was pulled from my cache- a copy of the image that was saved on my
hard drive. Since that image was cache'd without my permission, if I am
sued for copyright infringement, can I then sue either Mozilla or Linus
Torvalds?

Not very much I should use it more rather than sending files.

I'm puzzling over something and wonder
if you could, indeed WOULD, send me an item, perhaps a photograph, from
your Dropbox account so that I can check out a detail.

Here's my H&S poster I made for the my lab.

Wow! *HOT*! ;-)

and the first photo I took with my then new EOS M3
https://www.dropbox.com/s/9m28gsdm6t...0copy.JPG?dl=0

Your help is VERY much appreciated.

Thanks, Dave. :-)

What I mean is, post a link to the item here!

I'd appreciate that. TIA

The images are EXCEPTIONALLY clear! :-)

That wasn't what I was testing for, Eric.

Can YOU provide me with a Dropbox link too, please?

Try https://www.dropbox.com/s/rot11ikzko...-1643.jpg?dl=0

I've downloaded it before final posting and I'm not satisfied with
what I see. All the fine detail seems gritty.

It;s a relativley low res image at about 1800x1200 perhaps that's why.

doesn't help that it's leaves and riples on water which does make it look gritty.

It's still a lovely place to be! :-D

Did you catch my 'Ping', Dave?

You are right! It's the same here too. I don't know how that happened
but it started off as 3414 x 2268. I seem to have messed up
somewhere. I'll try again shortly.
