The evil in the derivative selling was the lack of adequate disclosure of the risks, which made any due diligence by the buyers impossible. If a buyer makes a purchase without adequate due diligence, the buyer bears the consequences. A large portion of The disclosure fraud committed was that certain banking institutions failed to disclose that they were taking a short position in the very same securities they were selling. They were selling: insured mortgage backed securities. Technically that is what a buyer received. The buyers never inquired into strength of the insurance company backing the securities, and more importantly the value of the realty securing the obligations.
