None of this matters if he doesn't have rights to the pictures. He DOES NOT
have a model release.

He does own the rights to the images. As soon as he releases the shutter the
ownership is his. All the model release does is allow him to sell the image.
Without a signed release he can not sell the image, but he still owns it.
